EFFECTIVE DATE – JUNE 1, 20091. Responsibility for identification and reporting of manufacturer’s defect lies with the customer. Said identification must be effected prior to use of the sail product and must be reported in writing to SOBSTAD (or one of its sales representatives) in writing immediately following said identification.
2. The manner in which said identification is handled relative to rectification (to include transportation of the subject sail) is the responsibility of SOBSTAD and will be effected on a case-by-case basis at its sole discretion.
3. Under no circumstance is SOBSTAD (or its sales representative) responsible for the payment of any invoice issued by any sail repair facility. Nor is SOBSTAD (or its sales representative) responsible in any way for any ALLEGED physical damage to human body or material property from ALLEGED performance, or lack thereof, of any SOBSTAD sail product.
